Defense Against Seller Fraud and Obtained Judgment Regarding Broker Standard of Care/Fiduciary Duties

Defended Seller in a $40 million lawsuit and was successful in securing judgment against the most prominent broker in this Midwest city for violation of standard of care and fiduciary duties

Lease-Purchase Option Valuation

For a public service headquarters, valued this 400,000 square foot building from a developer’s perspective. Identified a number a construction defects which diminished the value.

Valuation of Properties and Identification of Hard Money Ponzi Scheme

On behalf of the investors, won judgment for $5 million. For multiple properties involved in this ponzi scheme, put together the web of actions by the hard money lender, who was misappropriating the investors’ money.

For the State of California, served as an expert witness and testified regarding the redevelopment potential and valuation of Union Station.

For the Joint Powers Authority, served as expert for determining the "fair and reasonable" rents for the merchants of Olvera Street.

Broken Standard of Care / Fiduciary Duities

Represented land owner in a suit with broker, dealing with issues of "Fiduciary Responsibilities," "Standard of Care," "Fraud," "Misrepresentation," and "Dual Representation".

Hazardous Materials

On behalf of landowner, provided expert testimony regarding toxic dumping by major oil company.

Joint Use Development

Issues: Joint-use possibilities, land use concepts, zoning interpretation limitation, creative land valuation techniques required by the condemnation brought on by Los Angeles Unified School District.

Landlord-Tenant

Landlord-Tenant…on behalf of doctor, the case claimed violation of lease, breach of quiet enjoyment, threat to the health and safety of doctor and patients, wrongful lease termination and retaliatory actions.  The tenant won the case.

On behalf of landlord that had a five year lease for the entire building with one tenant, the landlord recovered all rent, tenant improvements and operating expenses and defended counter claim that they were not doing enough to release the space.
